These Terms of Service ("Terms") govern your access to and use of zappmeup, a service operated by zappmeup LLC ("zappmeup," "we," "us"). By creating an account or using zappmeup, you agree to these Terms. If you don't agree, don't use the service.
zappmeup turns a website into an installable app by giving it a hosted install page. From that page, a website's visitors can install the app to their home screen, opt in to push notifications, and get a personal inbox of what's been sent to them. You (the "Customer") connect one or more websites to zappmeup and use our dashboard to configure and send notifications; your website's visitors who opt in ("Subscribers" or "App Users") receive them.
Connecting a Squarespace site. You can connect a Squarespace site to zappmeup by approving the connection on Squarespace. Doing so authorizes zappmeup to access that site within the permission shown on Squarespace's approval screen, as described in our Privacy Policy. You must be the site's owner or authorized to connect it. You can disconnect at any time in your zappmeup dashboard or by removing zappmeup from your Squarespace site's extensions. Your use of Squarespace remains subject to Squarespace's own terms, and zappmeup isn't operated or endorsed by Squarespace.
You need a dashboard account to use zappmeup, and you're responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information when you sign up and keep it up to date. Subscriber accounts (created by your website's visitors to receive and view notifications) are separate from your dashboard account and are scoped to the specific website they signed up on.
zappmeup is offered as a paid subscription. Our plans, their prices, and what each one includes (such as the number of websites you can connect) are listed on our pricing page. Prices are in US dollars. Custom plans (such as Storm) are priced by separate agreement.
Free trial. Paid plans start with a 14-day free trial. You'll be asked for a payment method when you start the trial, but you won't be charged until it ends. If you don't cancel before the trial ends, your subscription begins automatically and your payment method is charged for the plan you chose.
Renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on the plan you chose) and your payment method is charged the then-current price, until you cancel.
Changing plans. You can switch plans or billing intervals at any time from the Billing page in your dashboard. A change takes effect right away, and the prorated difference for the rest of your billing period is charged or credited when you switch.
Cancelling. You can cancel at any time from the Billing page in your dashboard. Cancellation takes effect at the end of your current billing period (or at the end of your trial, if you cancel during it); you keep your plan until then and won't be charged again. Except where required by law, payments are non-refundable, including for partial billing periods.
Payments. Payments are processed by our payment processor, Stripe; we don't store your full card details. If a payment fails, we'll retry it, and if it still can't be collected we may suspend or cancel your subscription. If we change a plan's price, we'll tell you in advance, and the new price will apply from your next renewal after that notice.

We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.
You keep ownership of the content you upload or send through zappmeup — your app name, icon, branding colors, and notification text and images. You're responsible for that content and for having the rights to send it to your Subscribers. You grant us a limited license to store, process, and deliver that content solely to operate the service on your behalf.
We work to keep zappmeup reliable, but we don't guarantee uninterrupted availability, and we may modify, suspend, or discontinue features (including specific plan limits) with reasonable notice where practical. Some capabilities, such as background push delivery, depend on browser and platform behavior outside our control and on your website's own DNS configuration where applicable.
zappmeup, its dashboard, and the hosted install page are our property (or licensed to us) and are protected by intellectual property law. These Terms don't grant you any rights to our trademarks, logos, or branding beyond what's needed to use the service as intended.
You may stop using zappmeup and delete your account at any time from your dashboard settings. We may suspend or terminate your access for violating these Terms, non-payment, or if required by law. On termination, your connected websites stop being able to send notifications, and previously installed apps on Subscribers' devices may stop functioning.
zappmeup is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we aren't liable for indirect, incidental, or consequential damages arising from your use of the service, including lost notifications, lost subscribers, or lost revenue. Our total liability for any claim relating to zappmeup is limited to the amount you paid us in the twelve months before the claim arose.
These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law principles.
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new "Last updated" date. Continuing to use zappmeup after changes take effect means you accept the updated Terms.
